L'atto indegno e antipopolare di una parlamentare europea, che abusa di denaro e potere, per defraudare la Società Civile delle sue azioni più Alte. Una reale vergogna di fronte al Movimento della intera comunità internazionale.
 
Suscita sdegno l'atto di imporre a forza una sigla di partito, quando è in ballo il diritto stesso del Popolo Palestinese.
 
Una pubblica esposizione della corruzione tutta italiana della ricerca affannosa di una poltrona al Parlamento Europeo, per se o per altri candidati, mentre un popolo soffre per un genocidio lungo 60 anni, la costruzione di un muro alto 8 metri e a causa tutti gli attacchi bellici unilaterali di una potenza coloniale straniera.
 
Una azione Anti Popolare se proveniente dal Tribunale dei Popoli, l'atto di recidere la Società Civile dalle proprie iniziative, che sconfessa le radici culturali, morali e statutarie della Fondazione Lelio Basso.
 
Le antiche vestigia del Tribunale Russel faranno solo parole per la Palestina recando, come fu per l'Iraq, evidenti spaccature nella Società Civile.
 
Il diritto del Popolo Palestinese, da esercitarsi nelle aule di Giustizia nazionali ed internazionali, richiede fin da oggi la più ampia partecipazione politica e culturale in Italia e all'Estero. E' necessaria una coralità sociale, che interessi le formazioni politiche di sinistra, di centro e di destra, ed è un errore morale inaccettabile la ghettizzazione in una una sola sigla di partito.
 
Affinché ci sia un vero Giudice per il Popolo Palestinese sarà necessaria, inoltre, una Società Civile veramente pulita che investa di responsabilità morale Tutti i propri Parlamentari, ed anche i maggiori esponenti delle Grandi Religioni.
 
La Rete delle Associazioni di Artisti, che costituiscono Artists Against War Italia, è in Patria e all'Estero testimone reale della propria incessante solidarietà ai Popoli, del rispetto e della difesa delle libertà politiche, sociali e di culto di ogni uomo.
 
Siamo stati i Primi a parlare di Diritto di Resistenza dei Popoli, come sancito dai Trattati internazionali quando questo concetto era sconosciuto in Italia, ma non vogliamo la targa di anticlericali di partito: per il rispetto e la dignità dovuta a tutti i nostri rappresentanti in Italia e nel Mondo appartenenti a fedi diverse: mussulmani, ebrei israeliani, buddisti, cristiani - cattolici, protestanti e mormoni. 
 
Per noi ogni uomo è Uguale e da giudicarsi solo in base alle sue azioni contro altri uomini.
 
La Legge Deve essere Uguale per Tutti i cittadini.
 
Moni Ovadia: la falsa parcondicio.
 
L'invito all'artista è da ritenersi letteralmente una sostituzione di persona, in nome di una inesistente parcondicio, che i civili palestinesi di Gaza non hanno avuto, a copertura reale della estromissione degli Artisti Italiani, stante i documentabili precedenti rapporti con la segreteria della sezione internazionale di Fondazione Basso.
 
Inoltre Moni Ovadia, non ha mai aderito a nessuno dei molti appelli di Artists Against War tradotti anche in 9 lingue, come hanno fatto invece artisti del calibro di Paolo Belli, Manu Chao e dal circuito di Dario Fo. E non ci rappresenta.
 
Una sostituzione di persona, che appare come un fumo negli occhi per ingannare il francese avvocato Devers, legale rappresentante della nostra Associazione e di altre 430 associazioni nel mondo, e sfruttare così il ritorno di stampa super partes avuto dalla iniziativa di Artists Against War Italia sulla Corte Penale Internazionale.
 
Loredana Morandi, portavoce nazionale della Rete degli Artisti, è in sciopero della fame.
 
Hunger strike che cesserà esclusivamente con pubblico concordato chiarimento e ritrovata correttezza nell'agire provenienti da Fondazione Basso, che auspichiamo non voglia anteporsi oltre, in nome della sola cultura, alle Associazioni e alle Ong costituite in Diritto di fronte alla Corte Penale Internazionale per il Popolo Palestinese.

War Crimes Against Children: new report on the 313 children killed during Gaza offensive

A new report released today reveals the true extent of child killings by Israeli forces in the Gaza Strip during its 23 day offensive on Gaza between 27 December 2008 and 18 January 2009.

The Palestinian Centre for Human Rights (PCHR) is publishing War Crimes Against Children in response to the unprecedented number of children killed by Israeli forces in its latest operation; a total of 313 children under the age of eighteen. Containing numerous eye witness testimonies, the report brings to light Israel’s widespread targeting of unarmed civilians, including children, throughout the offensive.

‘Operation Cast Lead’ was the biggest Israeli military operation in the Gaza Strip in nearly 42 years of occupation. 1,414 Palestinians were killed, and PCHR investigations have found the overwhelming majority, 83 per cent, were civilians. One of the cases in the report is that of 18 month old Farah al-Helu, who was killed on 4 January. The al-Helu family had been told to evacuate their house in Zaytoun, eastern Gaza, but while they were attempting to flee, Israeli soldiers opened fire on them. Farah was shot in the stomach and bled to death two hours later.

War Crimes Against Children exposes the abject failure of Israeli authorities to uphold international humanitarian law, which provides protection for children in armed conflict and the lack of adequate precautions taken to distinguish between civilians and military targets. The report also details indiscriminate shelling of homes and schools where internally displaced people were sheltering, the psychological impact of the offensive, and the alarming scale of physical injuries inflicted on young people.

“We are calling for an independent full-scale investigation into all documented attacks on civilians during the offensive,” said Raji Sourani, director of PCHR. “Israel must be held fully accountable for the crimes it has perpetrated against Gaza’s civilian population, including alleged war crimes against children. We cannot allow the lives of these children to just be statistics in the history books of the Middle East.”

PCHR is calling on the international community to urge Israel to respect and uphold the human rights of Palestinians in the Occupied Palestinian Territory. “Urgent measures are needed in order to prevent further deaths,” added Mr Sourani.

The Centre is also recommending the urgent establishment of an independent committee to investigate the child killings. The committee must meet international standards of independence and transparency and publish its findings publicly.

NUCLEARE: LA BOMBA DI ISRAELE, UN SEGRETO NOTO A TUTTI       


ROMA, 6 MAG - Israele non ha mai firmato il Trattato di non proliferazione nucleare (Tnp) e ha sempre rifiutato di ammettere ispezioni internazionali al segretissimo reattore nucleare di Dimona, nel deserto del Neghev.

Anche se ufficialmente Israele non ha mai riconosciuto di possedere armi atomiche, nessuno pero' mette in dubbio che in realta' sia ormai una delle maggiori potenze nucleari.

Nel novembre 2001, in un documentario trasmesso dalla tv israeliana, l'allora ministro degli esteri Shimon Peres rivelo' che la Francia aveva accettato nel 1956 di dotare Israele di una ''capacita' nucleare'', fornendo ''non solo un reattore nucleare, ma anche dell'uranio''. All'epoca Peres, era direttore generale del ministero della difesa, incaricato del programma nucleare.

Il libro 'Rumsfeld's War', uscito nel 2004, afferma che - secondo un rapporto segreto della Defense intelligence agency (Dia) - Israele possiede 82 testate nucleari.

Secondo una stima fatta nel 2000 dagli esperti della Federation of american scientists (Fas), indicava che Israele potrebbe avere nei suoi arsenali fino a 200 ordigni nucleari (dato analogo a quello pubblicato nel 1994 dalla rivista di affari militari Jane's).

Nel 2002, il quotidiano di Beirut 'As-Safir', citando quello che veniva definito ''un rapporto militare Usa diffuso su Internet'', scrisse che Israele disponeva di 400 testate nucleari. Il documento diceva che nel 1967, all'epoca della 'Guerra dei sei giorni', Israele gia' disponeva di 15 bombe nucleari, salite a 20 nel 1973 durante la Guerra del Kippur e a 200 nel 1980. Il documento sosteneva inoltre che Israele ha ultimato il proprio programma nucleare nel 1995, riuscendo a produrre non solo bombe al neutrone, ma anche mine terrestri nucleari e missili nucleari che possono essere lanciati dai sottomarini.

Les crimes de guerre et contre l’humanité commis jusqu'à présent par Israël ont été couverts par la `justice israélienne’, tout comme l’ont été la torture, la démolition d’habitations palestiniennes à Jérusalem et dans les autres territoires occupés, les expropriations de terres, le Mur de séparation et autres crimes. La Cour Suprême israélienne a avalisé toutes les pratiques criminelles de l'occupation, en tentant de donner un habillage de légitimité juridique par des jonglages avec les normes juridiques de la Convention de Genève et du droit humanitaire.


La Cour suprême israélienne et les autres instances judiciaires de niveau inférieur, font partie de l'appareil d'occupation israélien, qui avec sa philosophie sioniste glorifie la suprématie de quelques-uns sur la population palestinienne et arabe en général. Il y a quelques jours, des travailleurs arabes israéliens étaient renvoyés des chemins de fer simplement parce qu’ils étaient d'origine arabe, et afin de donner ces postes à des vétérans juifs.

L’arrêté du juge Andreu contre les souhaits du Procureur (et du Ministère des Affaires Extérieures du Sieur Moratinos) indique trois choses : Gaza est un territoire occupé sur lequel Israël n'a pas de juridiction privilégiée ; qu’il n’a pas existé, et qu’il n’existe pas de procédure judiciaire indépendante des simples déclarations opportunistes des militaires ; et; et que ces dernières répondent à la politique exécutée par Israël dans ses actions d'occupation.

Les actes criminels que commet Israël n’ont jamais été judiciarisés avec des garanties en Israël, et aucune sentence n’a jamais été obtenue. Le dernier exemple est l’auto-exonération de ses crimes lors de l'attaque contre Gaza de janvier et sa détermination à défendre tous les exécutants de ces crimes devant quelque tribunal international que ce soit, au prix même de l’élimination des preuves et des témoignages.

Suite à cet arrêté, les parties civiles estiment que le Procureur doit cesser de servir de parapluie à l'Ambassade d'Israël, qu'il accomplisse sa tâche, qui est d’aider la justice et qu’il contribue à ce que justice soit rendue et que la compétence universelle soit exercée.

m writing to inform you that after having read the summary of the Chief of staff regarding the investigation of the event, the Military Advocate General decided that there was no reason to initiate an investigation of the matter by the Military Police. You were directly sent the response of the Military Advocate General on 01/03/2003, and in view of the circumstances the Attorney General has decided it is not necessary to get involved in this decision, which continues to be in force.”

As can be seen, in the documents submitted there is no resolution in which either the Military Advocate or the Attorney General of Israel express and justify the reasons for not initiating a criminal investigation geared at establishing the nature and circumstances of the events subject matter of this suit. The former refers to the internal inquiry carried out by the security authorities, and the latter former to the “summary of the Chief of Staff”, deciding not to get involved in the decision made by the Military Advocate.

4. In view of these replies, the “Yesh Gvul” Association and others submitted a petition before the Supreme Court of Jerusalem, dated 30/09/03, requesting that said Court “cancel the decision of the Military Advocate and Attorney General of Israel to not initiate a criminal investigation to determine if criminal offenses were committed during the planning and implementation of the attack against the Hamas activist Salah Shehadeh in Gaza City on 22/07/2002, action which caused the death of 14 persons and injuries to tens of others”. (This claim appears in appendix B-2).

5. Appendix B) contains the decision of the High Court regarding said petition, which gives rise to the Judgment of the Supreme Court sitting as High Court of Justice, on t23 December 2008. In these proceedings the following issues should be highlighted:

- The Judgment begins focusing on the subject matter of the proceedings: “Regarding the decision of the Legal Advisor of the Government to not initiate a criminal investigation in respect to the preventive attack carried out in Gaza City on 22/07/02 against the Hamas activist Salah Shehadeh.”

- And it points out the events regarding which an investigation is requested: “On 22/ 07/02, at night, an airplane of the Israeli Defense Forces dropped a 1000 kilogram bomb against a dwelling in Gaza City, the home of the high ranking civil servant Salah Shehadeh, target of the operation’s preventive attack. As a result of the operation, Shedadeh was killed, together with another Hamas activist who was with him and other 14 civilians, including Shehadeh’s wife and daughter, who were not involved in terrorist activities, and many other persons were injured. In the State’s response to the appeal, it said that following the operation and in view of its serious consequences, many investigations were carried out within the security system in connection with the operation, which lead the Military Advocate General and the Government’s Legal Adviser (Attorney General) to decide that there was no need to initiate a criminal investigation of the case.”

- The appeal was filed on 30/09/2003, requesting that said decisions be cancelled, and that they be instructed to initiate a criminal investigation to examine whether criminal offenses were committed during the planning and execution of the operation.

- On 24/03/2004, the Court decided to suspend processing of the appeal until a judgment was issued regarding file TSJ 769/02.

- On 14/12/206 a judgment was issued regarding file TSJ 769/02evels, particularly through the system of resources provided in its legal system, have adopted decisions that fully satisfy –from a constitutional perspective- the requirements arising from the application of the right to effective court protection by an independent and impartial justice.”

TWO – Before examining and assessing the documents submitted in this case, referred to by the Public Prosecutor’s Office in its writ, two matters must be clarified in respect to response to the request made:

First of all, the Prosecutor believes that the competence must be declared without effect “due to the preferential character of the jurisdiction of the State where the acts were committed.” Let us recall that the acts occurred in the City of Gaza, and that the entire international community accepts, without any discussion, that said territory is not part of the State of Israel.

In respect to this matter it suffices to read paragraph 2 of page 3 of appendix A-2 of the documents submitted by the authorities of Israel, in which the State Attorney of Israel points out: “Regarding acts committed in the territory of the Gaza Strip, they are currently acts committed on foreign territory, outside the territory of the State, in which the State of Israel does not exercise a military occupation, and which initially is similar to the territory of a foreign country in which acts of war are committed against the state of Israel.”

The second matter has to do with consistency of its final petition, because “declaring competence to judge the facts subject matter of this suit to be without effect” is hardly compatible with ordering the provisional stay of action, as requested. If Spanish jurisdiction is not competent to judge the facts subject matter of the suit, there is no other procedural solution other than the definite stay of the proceedings and dismissal of the suit.

THREE- In respect to the analysis of the actions carried out by the authorities of Israel in connection with the events under consideration, and in view of the documents submitted, the facts that we have established are the following:

1. As described in the documents submitted, on the 22nd of July 2002, between 11:30 PM and 12 midnight, an Israeli fighter F-16 jet dropped a one-ton bomb on the Al Daraj neighborhood of Gaza City. The main objective of the attack was the house of Salah Shehadeh, leader of the terrorist organization Hamas. The decision to attach was made at the highest military level, after the importance of Shehadeh’s activities had been demonstrated, with information and estimations regarding the harm that could be caused to third parties as a result of the attack.

The bomb exploded exactly in the safe house where Shehadeh was, killing him and another important Hamas activist who was with him; however, innocent civilians were also injured and killed by the bomb, in much larger numbers than what had be expected during the attack’s authorization phase.

A large number of the mortal victims in the attack died because they were in the house adjacent to the southern part of the building where Shehadeh was. The impact on the victims was not expected at the “decisive moment”, even though it had been established that this house would suffer from the attack on the basis of information stating that at the time of attack it would not be occupied. Said information was erroneous.

2. The Israeli Defense Forces carried out an internal inquiry, part of which appears in appendix B-3 of the documents submitted, on page 54 of which it states as follows:

“Within the framework of the claim, all of the material of the inquiry will not be presented, as some matters are classified and for the purpose of avoiding public exhibition of the most delicate informative and operative material. Nonetheless, the main conclusions arising from the inquiry of the events will be presented:

A) In respect to the target of the attack – Salah Shehadeh- it was discovered, beyond any doubt, that he served as head of a branch of Hamas during the current confrontations, and that attacking him was an essential part of the fight against terrorism and of the efforts to deactivate additional terrorist attacks.

B) In respect to the tragic impact against innocent civilians – it was discovered that the framework of preparing the attack there was no assessment, as it was considered that the impact against the individual was within the scope of the target or its surroundings. On the basis of these reports, had it been known for sure or as a possibility, that several other civilians would be killed and others injured, aside from Shehadeh’s wife, as a result of the attack, the attack would not have been permitted.

According to these reports, on some occasions before the day of the action, the possibility of executing the offensive against Shehadeh at some other specific time was cancelled, because of the target was in the close vicinity of innocent civilians and due to the wish to avoid causing an impact against them.

C) The reports analyzed thoroughly and in depth the space that existed between the prior assessment of the size of the attack and the results of the action. It was discovered that the space is produced as a result of a combination of factors, including:

- Information that was discovered to be erroneous subsequently –part of the information in the hands of the persons in charge of making decisions was discovered subsequently to be erroneous. This way, for example, the information regarding the building adjacent to Shedadeh’s house, which in the assessment was empty and during the action contained several civilians who died or were injured as a consequence of the attack.

Lack of information. Within the Security Forces, the information on the area of action was incomplete, and was not of excellent quality. This was due to the nature of this type of combat operations. For the people who carry out the operation in enemy territory dominated by hostile factors, the capacity of collecting information in advance is limited.

The conclusions of the reports establish that the possibility of having complex and tragic results as in this event -impact against several innocent civilians- was not what the persons in charge of making decisions expected, mainly because of the informative space, and certainly the result was caused with premeditation.

3. The Military Advocate General of Israel, in view of the conclusions issued by the Defense Forces of Israel in this internal inquiry, decided not to open a criminal investigation to determine the nature and circumstances of the events under consideration.

There is no evidence of any reasoned resolution that justifies this lack of action, and thus, in appendix C) of document B-2 (page 23), the Military Advocate refers to a request made in this sense by the Yesh Gvul (“There is a limit”) Association regarding whether any investigation of that issue had been initiated, which was answered by Lieutenant Colonel Sharon Afek, Head of the Department of Security and Exterior, who said that:

“Dear Sir,

In your letter of 9/02/2003 you asked whether an investigation regarding the circumstances of the death of the terrorist Salj Shjade had been initiated.

I wish to inform you that the aforementioned event was investigated by security personnel and the information was forwarded to the Military Advocate General. In view of the available information and considering the itinerary of the circumstances of the event, there is no reason to request an investigation by the Military Police.”
